Terms of Service

Welcome to Trefajob. These Terms of Service ("Terms") govern your access to and use of the website located at Trefajob.com and any related services (collectively, the "Service") operated by Tref A Job LLC, a New York limited liability company ("Trefajob," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Trefajob operates an online job board that allows employers to post job listings for a fee and allows candidates to view those listings and apply to them at no cost. Trefajob is not an employer, recruiter, or staffing agency. We do not screen, endorse, or verify employers, candidates, job postings, resumes, or any communications between users. Any employment relationship that results from use of the Service is solely between the employer and the candidate.

2. Eligibility

You must be at least eighteen (18) years old to create an account or otherwise use the Service. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into a binding contract. If we learn that a user is under 18, we will terminate the account and delete associated personal information in accordance with our Privacy Policy.

3. Accounts

To use most features of the Service you must register for an account. You agree to (a) provide accurate, current, and complete information; (b) maintain and promptly update your information; (c) keep your password secure and confidential; and (d) accept responsibility for all activity that occurs under your account. You must notify us immediately at Admin@TrefAJob.com of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

4. Employer Accounts and Paid Job Postings

4.1 Posting Fees

Employers pay a one-time fee per job posting. Fees are displayed at the time of purchase and are charged in U.S. dollars. We may change our pricing at any time, but changes will not affect job postings that have already been paid for.

4.2 Payment Processing

All payments are processed by Stripe, Inc. ("Stripe"). By submitting payment information you agree to Stripe's terms of service and privacy policy. Trefajob does not store full payment card numbers or bank account credentials on its own systems.

4.3 No Refunds

Except as required by law, all fees are non-refundable once a job posting is published. If a job posting is removed by Trefajob for violating these Terms, no refund will be issued. If Trefajob is unable to publish a posting due to a technical failure on our side, we will either re-publish the posting or refund the fee at our discretion.

4.4 Content Standards for Job Postings

Employers agree that every job posting will:

  • Describe an actual, currently available employment or contracting opportunity;
  • Comply with all applicable federal, state, and local employment laws, including anti-discrimination laws (Title VII, the ADA, the ADEA, the NYC Human Rights Law, and similar statutes) and wage and hour laws;
  • Comply with applicable pay-transparency laws, including NY Labor Law § 194-b and NYC Local Law 32, where applicable;
  • Not require candidates to pay any fee, deposit, or purchase as a condition of applying or being hired;
  • Not solicit unpaid labor unless lawfully permitted (e.g., a bona-fide internship meeting all FLSA criteria);
  • Not contain misleading titles, fake company names, multi-level-marketing schemes, adult-services solicitations, or content that violates Section 7 of these Terms.

5. Candidate Accounts and Applications

Candidates may create a free account, upload a resume, and apply to job postings. By uploading a resume and submitting an application, you authorize Trefajob to transmit your resume and application materials to the employer associated with the job posting. You are responsible for the accuracy of all information you provide and for ensuring you have the right to share any documents you upload.

6. User Content

"User Content" means any content you submit to the Service, including job postings, resumes, profile information, messages, and any other materials. You retain all ownership rights in your User Content. By submitting User Content, you grant Trefajob a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and use that content solely to operate, improve, and promote the Service. This license terminates when you remove the User Content from the Service, except that archived job postings (see Section 9) may continue to be stored under this license.

You represent and warrant that you own or have all necessary rights to your User Content and that the User Content does not violate these Terms or any applicable law.

7. Prohibited Conduct

You agree that you will not, and will not permit any third party to:

  • Use the Service for any unlawful purpose or in violation of any applicable law;
  • Post a job listing that is fraudulent, deceptive, or discriminatory;
  • Harvest, scrape, or otherwise collect resumes, candidate information, or any other data from the Service by automated means;
  • Use the Service to send unsolicited commercial messages, spam, or chain letters;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Upload viruses, malware, or other code designed to disrupt or damage the Service;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Use the Service to solicit payments, deposits, or sensitive personal information from candidates.

8. Intellectual Property

The Service, including all software, text, graphics, logos, and other content (other than User Content), is owned by Tref A Job LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. All rights not expressly granted are reserved.

9. Archiving of Job Postings

Job postings are archived rather than deleted when they expire, are filled, or are removed by the employer. Archived postings may remain in our systems indefinitely for record-keeping, fraud-prevention, dispute-resolution, and legal-compliance purposes. Archived postings are not displayed to the public in active search results.

10. Third-Party Services

The Service relies on third-party providers, including Stripe (payments) and Vercel (hosting and analytics). Your use of those services is governed by their respective terms and privacy policies. Trefajob is not responsible for the acts, omissions, or content of any third party, and links to third-party websites or services do not constitute an endorsement.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. Trefajob does not warrant that the Service will be uninterrupted, error-free, or secure; that job postings are accurate, legal, or legitimate; or that candidates or employers are who they claim to be. Trefajob does not guarantee that any employer will hire any candidate or that any job posting will receive applications.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will Tref A Job LLC, its officers, members, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory. Trefajob's total cumulative liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts paid by you to Trefajob in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Tref A Job LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

14. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice. You may close your account at any time by contacting Admin@TrefAJob.com. Sections 6 (license to User Content), 8, 9, 11, 12, 13, 15, 16, and 18 will survive any termination of these Terms.

15. Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your claims.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Kings County, New York, or by videoconference, at the claimant's option. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

Exceptions:Either party may (a) bring an individual action in small-claims court for any Dispute within that court's jurisdiction, and (b) seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to Admin@TrefAJob.com within thirty (30) days after first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.

16. Class Action Waiver

You and Trefajob agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action.

The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found to be unenforceable, then the entirety of Section 15 will be null and void.

17. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. For any Dispute not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Kings County, New York.

18. Changes to the Terms

We may modify these Terms from time to time. If we make material changes, we will post the updated Terms on the Service and update the Effective Date above. Material changes will become effective fourteen (14) days after they are posted (or sooner if required by law). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trefajob with respect to the Service. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
